PAYMENT
A RETAINER of 50% of the RBP Digital Collection is due upon scheduling to commission Rebecca for the date and time of the session.
Pre-paid retainer is non-refundable within 30 days of the portrait session, except in case of photographer cancellation due to weather or unforeseen circumstance. If client needs to cancel within the 30 day window, any monies paid may be used as a credit toward a future session. If the client cancels within 72 hours of the session date and time, or does not appear for the session, all monies paid will be forfeited.
NO OUTSIDE CAMERAS are allowed to be used by anyone during the session while Rebecca is present and working. If this occurs, Rebecca will regretfully halt the session and any monies paid in will be forfeited. Please inform ALL members of your party to this policy prior to the session time.
LOCATION
Rebecca will do her best to accommodate location requests, however she only photographs on an actual beach. Private home requests require prior site inspection. Rebecca reserves the right to determine the optimum location for a session and any location must meet her approval. In the case that the session needs to be rescheduled due to weather and can be moved to another time, the client may need to travel to another location other than the original planned location. If Rebecca can accommodate the client in this instance and the client chooses not to come to the revised location, this is considered a client cancellation and the retainer will be forfeited.
WEATHER
It is up to Rebecca's discretion ONLY if a session is to proceed or not due to weather.
On a date with questionable weather, the final call will be made three hours prior to the original meeting time on the day of the session and NOT earlier, as the weather can change drastically over the course of a day. Due to weather, the session may need to be moved to an earlier time. If you are not flexible with a revised meeting time anytime within the three hour window on the day of the session, it is considered a forfeiture of the retainer (and additional monies paid) if the session cannot be achieved due to incoming poor weather at the originally scheduled time.
NORMAL weather factors include WIND, CLOUDY SKIES, GRAY SKIES AND LIGHT FOG or MIST. These factors are to be expected and are more usual than not. A perfect sunny day is not always possible and is not always the most ideal condition for a portrait. As well, please keep in mind that when scheduling a coastal portrait, the beach is typically an exposed, open location and that many of the above factors will be present depending on the day. Rebecca will photograph unless cancellation is the only possible option, so based on the weather the day we are scheduled, please plan accordingly.
Please consider that a coastal portrait is about experiencing a moment in time at an amazing location that is stunning in any light.
COPYRIGHT
COPYRIGHT is protected by the Federal Copyright Law.
It is unlawful to copy or scan any images without permission of the photographer. The ONLY the digital packages offered include this permission. Again, scanning and/or copying the images photographed by Rebecca WITHOUT the purchase of the digital image is strictly prohibited. The additional resale of said images, or use of said images in advertising or other outside representation of the work of the photographer is always strictly prohibited. Rebecca Brown PHOTO retains the copyright and ownership of all images of the portrait session, and reserves the right to reproduce the images for portfolio, studio display, gallery display, website, self-promotion, photo contests, etc.
Clients are ONLY allowed to reproduce PURCHASED DIGITAL IMAGES for personal use.
I hereby consent that my name and the photographs taken and presented by Rebecca Brown PHOTO may be used by the studio for the purpose of display, portfolio, advertising, website or any publication to promote the studio or name. I also agree that the images can be used without additional compensation to the undersigned. I am of full age and have a right to contract in my own name. I have read this model release and fully understand the contents thereof. This release shall be binding upon me and my heirs, legal representatives, and assigns. I have legal authority to grant these permissions and I accept all responsibility for such. By signing this portrait agreement, you are also representing any persons in your party who will be photographed during this portrait session with Rebecca Brown PHOTOGRAPHER.
